1. Acceptance of Terms

By downloading, installing, or using Wake & Earn ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

Wake & Earn is a productivity tool that combines an alarm clock with app blocking and screen time management. The App allows you to set alarms with dismiss tasks (including pushup detection, math problems, shake, and typing), block selected apps using Apple's Screen Time framework, earn screen time by completing productive activities, and lock apps at bedtime. The App is a personal productivity tool and does not guarantee any specific behavioral outcomes.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

4. Account and Data

Wake & Earn does not require an account. All data is stored locally on your device. You are responsible for the security of your device and any data stored within the App. If you delete the App, all associated data is permanently removed.

5. Subscriptions and Purchases

Wake & Earn offers optional PRO subscriptions:

Subscriptions are processed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase (or at the end of the free trial period, if applicable). Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple ID account settings. No refunds are provided for partial billing periods.

6. App Blocking and Screen Time

Wake & Earn uses Apple's FamilyControls and Screen Time frameworks to block and unblock apps on your device, including the bedtime lock feature. You choose which apps to block. The App does not access the content of blocked apps or monitor your usage of specific apps. An emergency unlock option is always available. App blocking functionality depends on Apple's frameworks and may be affected by iOS updates or changes to Screen Time APIs. We are not responsible for disruptions caused by changes to Apple's systems.

7. Health Data

If you grant permission, the App reads step count and workout data from Apple HealthKit to calculate earned screen time. This data is processed on-device and is never transmitted, stored externally, or shared with third parties. You can revoke HealthKit permissions at any time through your device settings.

8. Camera Usage

If you grant permission, the App uses your device's front camera for pushup detection. The camera feed is processed in real time using on-device pose estimation. No images or video are recorded, stored, or transmitted. You can revoke camera permissions at any time through your device settings.

All content, features, and functionality of Wake & Earn, including but not limited to design, code, graphics, and trademarks, are owned by Alex Behling and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the effectiveness of the App in changing habits or reducing screen time.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Alex Behling shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. This includes but is not limited to missed alarms, inability to access apps, loss of data, or any disruption to your device's functionality.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be reflected in the App or on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Termination

We reserve the right to terminate or suspend access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or to us.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions.
